Limitasi Sistem Peradilan Pidana dalam Mengadili Kejahatan Supranatural Problem Irreducible Magic Power

Article 252 of Law Number 1 of 2023 criminalizes supernatural practices through a formal offense construction focusing on self-declaration of possessing magical powers. This article identifies a fundamental overlooked problem: the phenomenon of irreducible magic power intrinsic magical powers that cannot be stripped away through conventional punishment such as incarceration. This research aims to critically analyze the limitations of the criminal justice system in adjudicating supernatural crimes and introduce a new conceptual framework for evaluating the effectiveness of Article 252. The research urgency lies in the need to evaluate criminal policies regulating phenomena beyond the empirical reach of the justice system, considering potential law enforcement failures and post-punishment social paradoxes. The method employed is normative-juridical with statutory and conceptual approaches, utilizing primary and secondary legal materials analyzed qualitatively. Main findings reveal three layers of fundamental limitations: epistemological limitations in proving the existence of magical powers, penological limitations because incarceration cannot halt the continuity of magical power, and sociological limitations manifested as post-punishment paradoxes that potentially strengthen public belief in the perpetrator's power. This research recommends shifting policy focus from metaphysical proof to measurable social impacts, and strengthening the role of customary law and restorative mechanisms in handling conflicts based on supernatural accusations.
